Your Dues!

Annual dues are necessary for the sole purpose of maintaining the common properties of the Union Village. This includes the maintenance of the landscaping and signs at the entrances to Union Village on Braxton Drive and Richmond Drive. The dues also cover the maintenance and cost of operation of the gas street lights, not to mention maintaining liability insurance for the common properties.

It is necessary that all properties share equally in the responsibility to maintain these qualities or assets of Union Village. Unfortunately, there are a number of properties that are not honoring their responsibilities regarding this matter. This has resulted in several property liens, as well as actions taken in Small Claims Court at the Boone County Courthouse. The failure to honor these obligations only harms the Home Owners' Association, and the individual residents of the Union Village. Failure to collect these dues, combined with escalating natural gas and landscaping costs, only threatens the need to raise the homeowner's dues!

It is only fair to inform all homeowners, that according to "the bylaws", any property delinquent in the paying of these dues, shall have their voting rights suspended until brought current! This is critical as this January the members of the Home Owners' Association will be voting on several critical amendments to "the bylaws", not to mention the discussion of any necessary increases in Association dues!

It should also be known that according to the by-laws, all costs attributed to the collection of unpaid dues, or rectifying of infractions against the Covenants, Conditions, and Restrictions is the sole responsibility of the offending party. Suffice it to say that if the Board, or any Association Member, finds it necessary to pursue legal action to rectify situations that are directly forbidden by the "Declaration of Covenants, Conditions, and Restrictions of Ownership", then the offending property owner will pay all legal fees, court costs, and any restitution amounts!

The By-Laws also stipulate the Board of Directors shall apply interest and penalties of unpaid dues, suspend voting rights of offending parties, and to be responsible for the collection of said dues!

This part isn't fun, folks! Please don't make this any harder than it has to be!!!
